Agreement to these terms
These terms form a binding agreement between you, whether personally or on behalf of an organization, and Merensa Advisory Limited, concerning your access to and use of this website. By using the site you confirm that you have read and accepted them. If you do not accept them, please leave the site.
The site is intended for people aged 18 and over, acting in a professional capacity. It requires no account and no registration; should that change, these terms will be updated before any account feature opens.
We may revise these terms. The revised version takes effect when posted, and the date at the head of the page marks the current one. Continuing to use the site after that date is acceptance of the revision.
Who we are
Merensa Advisory Limited (“Merensa”, “we”, “us”) is a company incorporated in the Federal Territory of Labuan, Malaysia. We provide senior strategic advisory and this site describes that work; it is not the work itself.
Nothing on this site is directed at any person in a jurisdiction where its publication or use would be contrary to local law, or would subject us to a registration requirement there. If you access the site from such a place, you do so on your own initiative and are responsible for compliance with your own law.

Nothing here is advice
Everything published here, including anything under Insights, is general commentary written without knowledge of any particular institution’s circumstances. It is not strategic, legal, financial, regulatory, tax or other professional advice, and it must not be relied on as a substitute for advice given to you on your own facts.
Advice from Merensa is given under a written engagement, addressed to a named client, and it speaks only to the matter and the moment it was written for. Material on this site may become out of date, and we are under no obligation to update it.
No engagement is formed by contacting us
Reading this site, sending an inquiry through it, or holding an exploratory conversation with us does not by itself create an advisory relationship or any duty of care owed to you.
An engagement begins only when its scope, fees and terms are agreed in writing separately between you and Merensa. Until then, we are free to decline the matter, and we may already be acting for another party with an interest in it.
What you send us
We treat inquiries in confidence and handle them as set out in the privacy notice. Even so, please do not send material you regard as highly confidential, price-sensitive or privileged through a web form. Keep sensitive conversation on a secure channel.
Because no engagement exists at the point of first contact, material sent before one is agreed is not covered by an engagement letter’s confidentiality terms and may not attract legal privilege.
You confirm that what you send us is accurate so far as you know it, that you are entitled to send it, and that in doing so you breach no obligation of confidence owed to anyone else.
If you volunteer a suggestion about this site or our services, unprompted and outside an engagement, we may use it without obligation to you. That applies to the suggestion itself; it does not extend to confidential information about you or your organization, which remains yours and is held under the privacy notice.
Our intellectual property
We own or are licensed to use everything that makes up this site: the text, the design, the code, the imagery, and the Merensa name and marks. All of it is protected by copyright, trademark and related law in Malaysia and elsewhere.
You may read the site, or print portions of it, for your own reference or your organization’s internal purposes. Quoting a passage with attribution to Merensa is welcome.
Beyond that, nothing here may be copied, republished, systematically collected, translated, redistributed, sold or exploited commercially without our written permission. Text on this site may not be used to train machine learning models. Requests for any other use go through the contact page. All rights not expressly granted are reserved.
Acceptable use
Use the site for the purpose it exists for. In particular, you agree not to:
- Scrape, mine or systematically extract content, whether to build a database, a directory or a training corpus. Ordinary search engine indexing is fine.
- Interfere with the security of the site, or attempt to reach any part of it not made public.
- Introduce malicious code, or place an undue load on the site or the networks it depends on.
- Send false, misleading or impersonating inquiries, or use the form to solicit, advertise or send unsolicited mail.
- Remove a copyright or proprietary notice from anything you take from the site.
- Frame or link to the site in a way that misrepresents its source or implies an association we have not agreed to.
- Use the site in breach of any law that applies to you.
We may monitor the site for breaches of these terms, and may restrict or withdraw access where we find one. We are not obliged to do either.
Third-party sites and content
Where we link to another site or cite another organization’s material, we do so because it is useful, not because we have verified it or endorse it. We do not control those sites and take no responsibility for their content, accuracy or privacy practices.
When you follow a link away from here, these terms stop applying and the other site’s do. Read them.
Availability and changes
We may change, correct, withdraw or restructure any part of this site at any time, and we are under no obligation to keep any particular page available or current. The site may be interrupted for maintenance or by faults beyond our control, and we do not warrant uninterrupted access.
There may be typographical errors or omissions here. We correct them when we find them, without prior notice.
Privacy
Our handling of personal data is set out in the privacy notice, which forms part of these terms. It explains what we collect, how long we keep it, and the rights you hold under the Malaysian Personal Data Protection Act 2010.
Our infrastructure sits partly outside Malaysia, so using this site may involve a transfer of your data across borders. Section 6 of the privacy notice explains the basis on which we permit that.
Disclaimer
The site is provided as it stands and as it is available. Your use of it is at your own risk. To the fullest extent the law allows, we exclude all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We make no warranty that the content is accurate or complete, that the site will be free of interruption or error, or that it or its servers are free of malicious code. Nothing in this section excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, or for fraud.
Limitation of liability
To the fullest extent the law allows, neither we nor our directors, employees or agents are liable to you or to any third party for indirect, consequential, incidental, special or punitive loss, or for lost profit, lost revenue or lost data, arising from your use of this site, even if we were told such loss was possible.
Our total liability arising out of or in connection with this site, on any basis, is limited to one thousand Malaysian ringgit (RM1,000). Liability arising from an advisory engagement is not governed by this section; it is governed by the engagement letter, which carries its own liability terms.
Some laws do not permit certain exclusions or limitations. Where such a law applies to you, the limitations above apply only so far as that law permits, and your statutory rights are unaffected.
Indemnity
You agree to hold us harmless against any third-party claim, and the reasonable legal costs of defending it, arising from your breach of these terms, your infringement of a third party’s rights, or your misuse of this site.
This does not extend to anything caused by our own negligence or our own breach of these terms, nor to matters outside your control. We will tell you promptly of any claim to which it applies, and we may take over its defense at our own election.
Governing law and disputes
These terms are governed by the laws of Malaysia, without regard to conflict of law principles. You and Merensa submit to the non-exclusive jurisdiction of the Malaysian courts.
If a dispute arises, tell us first. Both parties agree to attempt to resolve it in good faith for thirty days from written notice before commencing any formal proceeding. Most things are settled in that period.
If it is not resolved, either party may refer the dispute to arbitration in Kuala Lumpur under the Arbitration Rules of the Asian International Arbitration Centre, before a single arbitrator, in the English language. Arbitration is confined to the two parties: no consolidation with another proceeding, no class or representative claims.
Three things fall outside that route and may go straight to a court: claims about intellectual property rights, claims alleging unauthorized access or misuse of confidential information, and any application for injunctive relief.
Access and termination
These terms apply for as long as you use the site. We may withdraw access, including by blocking an address, where we consider these terms or the law to have been breached, and we may pursue any other remedy available to us.
The sections on intellectual property, disclaimer, liability, indemnity and governing law survive the end of your use of the site.
General
These terms, together with the privacy notice, are the entire agreement between us concerning this site. If we do not enforce a provision on one occasion, we do not waive it. If a provision is held unlawful or unenforceable, it is severed and the rest stands.
We may assign our rights and obligations under these terms. Nothing in them creates a partnership, joint venture, employment or agency relationship between us. Visiting the site and submitting the contact form are electronic communications, and you agree that notices we give electronically satisfy any requirement that they be in writing.
We are not liable for any delay or failure to perform caused by something beyond our reasonable control.
